Website design services are delivered as outlined in the applicable agreement. Upon full payment, bespoke visual designs created specifically for your website are transferred subject to third-party licensing restrictions; proprietary code, open-source code, third-party software, tools, and unused concepts remain with their respective owners unless agreed otherwise in writing. SEO services aim to improve visibility but do not guarantee rankings. Hosting and email services may be interrupted for maintenance, technical issues, policy violations, or non-payment and are subject to the limits and responsibilities in your agreement. Additional services may include separate terms or addenda.
All sales are final. Paragon Media One Inc. does not offer refunds for website design, search engine optimization, digital marketing, email, hosting, social media marketing, or other services unless a written agreement expressly states otherwise.
We strive to deliver reliable services but do not guarantee uninterrupted availability. Maintenance, technical issues, third-party systems, and unforeseen circumstances may affect service. We are not liable for damages arising from service unavailability to the extent permitted by law.
If payment is not made when due, Paragon Media One Inc. may interrupt, suspend, or cancel services and may remove associated website files, email data, or other content. Past-due balances remain payable, and reconnection or restoration fees may apply. Non-payment may result in loss of access to or deletion of data, and we are not liable for resulting losses to the extent permitted by law.
Website content, design, graphics, logos, trademarks, and other elements are owned by Paragon Media One Inc. or its licensors and protected by intellectual-property laws. They may not be reproduced, distributed, displayed, or adapted without permission. Client-provided logos, text, images, and other content remain the client’s property, while the client grants us the rights reasonably necessary to provide the services. Campaign content is licensed for the agreed use; proprietary tools, templates, strategies, and software remain ours or the applicable licensor’s unless a written agreement says otherwise.
We may suspend or terminate access to the website or services for violations, non-payment, or other reasons permitted by an applicable agreement or law. Access to associated services and data may be revoked or deleted.
The website and services are provided “as is” and “as available,” without express or implied warranties to the extent permitted by law. We do not guarantee marketing results, conversions, search rankings, traffic increases, 100% hosting uptime, data integrity, email delivery, or protection from spam filters. We do not guarantee uninterrupted, error-free, or completely secure services. To the extent permitted by law, Paragon Media One Inc. is not liable for direct, indirect, incidental, special, or consequential damages arising from use of or inability to use the website or services. No system can provide absolute protection against security incidents or data breaches.
Except where a service-specific agreement provides otherwise, these Terms and applicable service agreements constitute the agreement regarding use of the website and services and supersede prior communications on the same subject. Service agreements supplement these Terms and control where they expressly differ. Electronic notices and records may be treated like printed business records. These Terms are prepared in English.
These Terms are governed by Pennsylvania law. Disputes arising from these Terms or our services will be resolved through binding arbitration in Pennsylvania under the rules of the American Arbitration Association, unless prohibited by law or otherwise stated in a written service agreement. You agree to waive a jury trial or class action to the extent enforceable.
Use of our website and services is also governed by our Privacy Policy, which explains how we collect, use, store, and protect personal information.
If any provision of these Terms is found invalid, illegal, or unenforceable, that provision will be severed and the remaining provisions will continue in effect to the fullest extent permitted by law.
